Certificate of Health Care Provider

Certification issued by a health care provider may be required to support an employee's request for leave due to a serious health condition of the employee or a family member. Employees must be given at least 15 calendar days after a leave request in which to provide certification, or as soon as is reasonably possible if the need for leave was not foreseeable. Employers may delay the taking or continuation of leave if an employee fails to provide timely certification.

The Labor Department has developed an optional form, Form WH-380, that meets FMLA certification requirements. Another form containing the same basic information may be used, but no additional information may be required.
