2008 VETS-100 Report Due Sept. 30

The filing deadline for the 2008 VETS-100 Report is September 30, 2008. The Department of Labor’s Veterans’ Employment and Training Service (VETS) annually collects and complies this information from federal contractors with federal contracts that were entered into before December 1, 2003 and have a value of $25,000 or more. Each year, the VETS-100 reporting cycle begins on August 1 and ends September 30. Accordingly, VETS began accepting reports on August 1, 2008. 

As it did last year, VETS is encouraging online submission of the report through the website at www.vets100.com. However, mailed filings, as well as properly formatted disk filings, are acceptable. Those contractors needing a report form should visit the  www.vets100.com website or notify the VETS-100 Help Desk. 

VETS-100A reporting begins in 2009. On May 19, 2008, VETS published in the Federal Register (73 FR 28710-28725), a final rule to implement changes to veterans reporting obligations for federal contractors required by the Jobs for Veterans Act of 2002 (JVA). The JVA amended the Vietnam Era Veterans’ Readjustment Assistance Act of 1974 (VEVRAA); it raised the VETS-100 reporting threshold from $25,000 to $100,000 and modified the categories of veterans to be tracked in the reports for contracts entered on or after December 1, 2003. The final rule created a new Part, 41 CFR Part 61-300 and adopted a new report form -- Federal Contractor Veterans’ Employment Report VETS-100A -- to implement the changes. 

The report required for contracts entered before December 1, 2003, continues to be the VETS-100 Report. The report required for contracts entered on or after December 1, 2003 is the new VETS-100A Report. A contract modified on or after December 1, 2003, that was entered into before December 1, 2003, constitutes a new contract -- and therefore, requires the contractor to file a VETS-100A report. Contractors that have contracts which fall into both categories will be required to file both forms. 

The new rule regarding the VETS-100A report did not take effect until June 18, 2008 and consequently, did not take effect in time for covered contractors to collect data for the entire 12-month period ending on a date between July 1 and August 31, 2008. Accordingly, VETS has decided that covered contractors are to collect and maintain the data prescribed by the new Part 61-300 regulations beginning in the calendar year 2008 (on a date between July 1 and August 31) and report the data in the VETS-100A Report to be filed by September 30, 2009.
